Bail on the mesne process of civil arrest, otherwise known as bail to the action, put into the court on the return day of the writ, wherein the undertaking of the surety, in the event of judgment against the principal, was either to pay the judgment debt and costs or surrender the principal into custody. 8 Am J2d Bail § 1.
