- A summary proceeding in a court of bankruptcy brought for the purpose of summarily retrieving for the trustee in bankruptcy, who is entitled thereto, assets concealed and diverted from him the efficacy of such proceeding appearing in the fact that the withholding of such assets pending the outcome of plenary suits to recover them would intolerably obstruct and delay administration of the bankrupt estate. 9 Am J2d Bankr §§ 1137 et seq.
