A person to whom a right is assigned, that is, the one to whom an assignment is made. 6 Am J2d Assign § 2. A person who becomes invested with the right of another person through some voluntary act of that other person. United States v Colorado Anthracite Coal Co., 225 US 219, 56 L Ed 1063, 32 S Ct 617. More broadly defined as including all those who take either immediately or remotely from or under the assignor, whether by conveyance, devise, descent, or act of law. Hoffeld v United States, 186 US 273, 46 L Ed 1160, 22 S Ct 927. Where there are no qualifying words, the term in its usual meaning refers to an assignee in fact and does not comprehend an assignee by mere operation of law, such as a surviving partner. Burlington Nat. Bank v Beard, 55 Kan 773, 42 P 320. The words "assignee of such deceased person" in a statute disqualifying an adverse party as a witness is limited to an assignee in fact, and does not include an assignee by mere operation of law. So construed, the word does not include a legatee, a purchaser at an execution sale, or a trustee appointed on the death of a testamentary trustee. 58 Am J1st Witn § 335.
