To give up, to give back the office with intent to relinquish it. A prospective resignation may, in point of law, amount but to a notice of intention to resign, since it is not accompanied by a giving up of the office; possession is still retained and may not necessarily be surrendered till the expiration of the legal term of the office, because the officer may recall his resignation,-may withdraw his proposition to resign.
