- A phrase to be found in appeal bonds. The weight of authority holds that the expression means more than a mere prosecution of the appeal to a final determination and that it requires a final determination in favor of the appellant. But other authorities hold that the phrase merely means a prosecution of the appeal is to be conducted with due diligence to a final determination, whether favorable or unfavorable to the appellant. 5 Am J2d A & E § 1030.
