The fundamental principle of criminal procedure that after indictment found, nothing shall be done in the absence of the prisoner and the correlative right of the accused to be present at his own trial. 21 Am J2d Crim L § 271. The right of the accused to be present at all stages of his trial, applicable in all capital cases, in fact, in all felonies; also applicable in prosecutions for misdemeanors to the extent that the accused undoubtedly has the right to be present, although in some jurisdictions authority to proceed in his absence is recognized where only a misdemeanor is involved. 21 Am J2d Crim L § 272.
