mixed action

mixed action
An action appertaining in some degree to both real and personal actions, and therefore properly referable to neither of such classes. To illustrate, an action for the recovery of the possession of real property and damages for waste committed by the defendant. Thayer v Shorey, 287 Mass 76, 191 NE 435, 94 ALR 307.
