ministerial act
An act which does not involve the exercise of judgment. An act the performance of which involves nothing of discretion, official or otherwise, performance being required by direct and positive command of the law. 34 Am J1st Mand § 70. An act which a person performs under a given state of facts, in a prescribed manner, in obedience to the mandate of legal authority, and without regard to or exercise of his own judgment upon the propriety of the act being done. Galey v Board of Comrs. 174 Ind 181, 91 NE 593. An Act in the performance of a duty defined and prescribed by law with such precision and certainty as to leave nothing to the exercise of discretion or judgment. Rains v Simpson, 50 Tex 495.
