among the several states
A phrase used to distinguish between commerce which concerns more states than one and commerce confined within one state and not affecting other states. Such distinction pertains to the power of Congress to regulate commerce, it having the power under the commerce clause only as to commerce between the states. 15 Am J2d Com § 3. Commerce in the District of Columbia and the territories of the United States, although within the power of Congress to regulate by virtue of its authority over such areas, is not commerce among the several states. 15 Am J2d Com § 3. The business of producing stage attractions, including plays, musicals, and operettas, on a multi-state basis, constitutes commerce among the several states. United States v.
