levying war
A term including, not only the act of making war for the purpose of overturning the government, but also any combination forcibly to oppose the execution of any public law of the United States, if accompanied or followed by an act of forcible opposition to such law in pursuance of such combination. Druecker v Salomon, 21 Wis 621. War is actually levied when a body of men are actually assembled for the purpose of effecting by force a treasonable object. See Burr's Case (US) 4 Cranch 473, 2 L Ed 686.
