justifiable homicide
An excusable homicide. State v Trent, 122 Or 463, 259 P 893. A homicide committed: (1) by unavoidable necessity without any will, intention, desire, inadvertence, or negligence on the part of the person killing, (2) for the advancement of public justice, or (3) for the prevention of any atrocious crime attempted to be committed by force. Erwin v State, 29 Ohio St 186.
