judicial department of the United States

judicial department of the United States
The department created by article III of the Federal Constitution, consisting of one Supreme Court and of such inferior courts as Congress shall, from time to time, ordain and establish. In these courts is vested the judicial power of the United States. This power of Congress to create inferior courts does not make it a matter of discretion to create them or not at its pleasure, but is rather a duty to vest the whole judicial power. Martin v Hunter (US) 1 Wheat 304, 4 L Ed 97.
