In the application of a fiction of the law, equity will prevail. State ex rel. Watson v Standard Oil Co. 49 Ohio St 137, 30 NE 279. A fiction is maintained where it may contribute to the advancement of justice; it will not be allowed to work an injury or prejudice to any party. Low v Little (NY) 17 Johns 346, 348.
