exclusive control

exclusive control
A control which is limited in respect of the person by whom exercised, but not necessarily limited to one person. Mack v Reading Co. 377 Pa 135, 103 A2d 749, 41 ALR2d 927. The word "exclusive" when used to define the nature of the control necessary to invoke the doctrine of res ipsa loquitur does not connote that such control must be in a single person, and the fact that a collapsing scaffold causing the injury was in control of both defendants, a general contractor and his subcontractor, does not preclude operation of the doctrine. Meny v Carlson, 6 NJ 82, 77 A2d 245, 22 ALR2d 1160.
