A phrase not susceptible of exact definition; generally, a guaranty under the Fourteenth Amendment to the United States Constitution that no person or class of persons shall be denied the same protection of the law which is enjoyed by the other persons or other classes under like circumstances, in their lives, liberty, property, and in pursuit of happiness. Truax v Corrigan, 257 US 312, 66 L Ed 254, 42 S Ct 124, 27 ALR 375. Concisely stated, the guaranty of equal protection means that the rights of all persons must rest upon the same rule under the same circumstances, both in privileges conferred and in liabilities imposed.
