departure
A leaving, such as the departure of a bus from the station; a turning aside from a usual route. A changing of the cause of action or defense alleged in a pleading, either in substance or the law upon which it is founded, in an amendment to the pleading, a reply, rejoinder, or other subsequent pleading. 41 Am J1st Pl §§ 184, 185. The test whether new matter introduced by the way of an amendment is a departure is whether a different character of evidence is required for its support than would be required for proof of the antecedent pleading and whether proof of additional facts will be required to sustain the later pleading.
